Classification of Crimes

Fort Bend County Criminal Defense Lawyer Anthony R. Misdemeanors

A misdemeanor offense is punishable by fine, confinement in jail or both.  There are three classes of misdemeanors:

  1. Class A - punishable by up to one year in county jail and/or fine not to exceed $4,000.00

  2. Class B - punishable by up to 180 days in county jail and/or fine not to exceed $2,000.00

  3. Class C - punishable by fine not to exceed $500.00.

The range of punishment described above may be enhanced as a result of a person's prior criminal background or as required by statute.

 

Felony

A felony is punishable by imprisonment in the institutional division of the Texas Department of Criminal plus a fine.   There are four classifications of  felonies:

  1. Capital - a person convicted of a capital felony in which the state seeks the death penalty must be punished by death or imprisonment in the institutional division of the Texas Department of Criminal Justice (TDCJ) for life.  If the state did not seek the death penalty, the person must receive life imprisonment.
  2. First Degree - a person convicted of a felony of the first degree is punished by imprisonment in the institutional division of the TDCJ for life or for any term of not less than 5 nor more than 99 years, plus a fine of not more than $10,000.00.
  3. Second Degree -  person convicted of a felony of the second degree is punished by imprisonment in the institutional division of the TDCJ for a term of not less than 2 nor more than 20 years, plus a fine not to exceed $10,000.00.
  4. Third Degree -  person convicted of a felony of the third degree is punished by imprisonment in the institutional division of the TDCJ for life or for any term of not less than 2 nor more than 10 years, plus a fine of not more than $10,000.00.
  5. State Jail Felony - An offense designated as a felony in the penal code without specification as to degree is a State Jail Felony.  A person convicted of a State Jail Felony is punished by confinement in a state jail for a term of not more than 2 years or less than 180 days, plus a fine not to exceed $10,000.00.  Notwithstanding the foregoing, a person convicted of a state jail felony must be punished for a third degree felony if either of the following is shown at trial:
    1. Use of a deadly weapon in commission of the offense or during immediate flight following the offense; or

    2. The person has previously been convicted of any of the following felonies: capital murder, murder, intentional injury to a child resulting in serious bodily injury, continuous sexual abuse of a child, indecency with a child, sexual performance by a child, sexual assault, aggravated sexual assault, aggravated robbery, aggravated kidnapping, or an offense in the which the penalty has been increased under the drug free zone provisions' or any felony offense in which the judgment contains a deadly weapon finding.
